Disparate Treatment | Meaning and Definition

What is Disparate treatment?

It refers to varied and discriminatory implementation of regulations and legislation towards members of a civil right. Disparate treatment employment discrimination intentionally eliminates an employee from work opportunities. 

This treatment is recognized as a legal basis for a human rights infringement to be enforced. Even in the workplace, this rule prohibits discriminating depending on ethnicity, sexual identity, national or ethnic origin, or creed. While the federal government does not address sexual orientation, most states do. Minorities, foreigners, and women are some of the people who would be affected. Many people who are not part of favoured categories, including such men and members of the predominant caste, would claim that they have been treated unfairly in court. 

Disparate treatment originally referred to purposeful discriminatory behaviour in which members of a particular category are mistreated. The most prominent unequal treatment is this. An organization, for example, might administer a test to all women who seek a position but not to any men.
